Terms of service

These Terms of Service ("Terms") apply to your use of the Sundaze Shade store and website and to any order or pre-order you place with us. By using the store or placing an order, you agree to these Terms. Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

1. Pre-orders — Founder's Edition

Products in the Founder's Edition are sold on a pre-order basis. This means:

  • Payment is taken at checkout, at the time you place your pre-order.
  • Estimated dispatch is early November 2026. This is a genuine estimate based on our current production schedule, not a guaranteed date.
  • We will keep you informed by email with production and shipping updates.
  • You can cancel your pre-order for a full refund at any time until production begins on 15 September 2026. Email hello@sundazeshade.com with your order number.
  • After 15 September 2026, your order is committed to manufacturing and change-of-mind cancellations are no longer available. Your rights under the Australian Consumer Law are not affected.
  • If your order has not been dispatched by 30 November 2026, you may cancel it at any time until dispatch and receive a full refund.
  • If we become aware of a material delay to the estimated dispatch window, we will notify you promptly and you may choose to keep your pre-order or cancel it for a full refund.
  • If we are unable to fulfil your pre-order for any reason, we will cancel it and issue a full refund.

2. Product specifications

The Founder's Edition is the first production run of Sundaze Shade. Images and specifications shown on the store reflect the current design; minor refinements may be made before production is finalised. If any change is material to the nature of the product, we will notify you before dispatch and you may cancel for a full refund.

3. Pricing and payment

All prices are shown in Australian dollars (AUD) and include GST where applicable. Founder's Edition pricing is limited to the founder production run. We reserve the right to correct pricing or listing errors; if an error affects your order, we will contact you before proceeding and you may cancel for a full refund.

4. Shipping

We currently ship to Australia only. Delivery is governed by our Shipping Policy.

5. Returns and refunds

Returns and refunds are governed by our Refund Policy and the Australian Consumer Law.

6. Consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7. Liability

To the extent permitted by law, and subject always to the consumer guarantees above, our liability for any claim arising out of or in connection with your order is limited to the amount you paid for the relevant product. We are not liable for indirect or consequential loss to the extent such liability can lawfully be limited.

8. Intellectual property

All content on this store — including the Sundaze Shade name, wordmark, illustrations, photographs and copy — is owned by or licensed to us and may not be reproduced without our written permission.

9. Changes to these Terms

We may update these Terms from time to time. The version in force when you place your order applies to that order.
